Mastering MPCB Consent Procedures (CTE/CTO)
A definitive guide to obtaining and maintaining Consent to Establish and Consent to Operate in Maharashtra.

Quick answer
MPCB consent has two stages: Consent to Establish (CTE) before construction or expansion and Consent to Operate (CTO) before production. Applications need a correct category, process details, water balance, pollution load and treatment scheme. Incomplete documents and wrong categories are the most common causes of delay.
1. The Legal Framework
Any industry, operation, or process that discharges sewage/trade effluent into the environment or emits pollution into the air must obtain consent from the State Pollution Control Board. In Maharashtra, the MPCB enforces these rules under the Water Act (1974) and Air Act (1981).
2. Step-by-Step Consent Mechanics
The consent procedure is divided into two strict phases. Bypassing either leads to immediate closure orders and criminal prosecution.

1
Consent to Establish (CTE)
Applied for before construction begins. The industry must submit detailed land documents, project reports (DPR), expected effluent generation matrices, and proposed pollution control designs (ETP/Air scrubbers). The MPCB evaluates if the local ecology can handle the proposed load.

2
Consent to Operate (CTO)
Applied for at least 60 days before commencing commercial production. MPCB officials will physically inspect the site to verify that the ETP, chimneys, and hazardous waste storage sheds were built exactly as promised in the CTE.
3. The Renewal Trap
CTO is not a one-time clearance. It comes with a validity period (1 to 5 years). Application for renewal must be filed 60-120 days before expiry. Industries often fail to renew because they neglected to submit their annual Environmental Statements (Form V) or Water Cess returns.
